Are You Tired of Being a Victim?

You need help, but help is not readily available through government programs, neighborhood doctors, or hospitals. Everyone, it seems, in the State of Texas is profit driven, and if you don't have the money for health insurance or health care in general, you are just left to suffer your loss. (One exception to this rule is the emergency room. Go to the emergency room. Most hospitals, if they are county hospitals, have to see you and will see you. This also documents your injuries and gets you the care that you need.) There is help here. I live and work in the State of Texas, and have practice law in North Texas for two decades. I was once proud of our state and local government, and it seemed like the government cared about the people, and cared about the common working man, but that's not the case anymore. Here comes the political commentary.

Unfortunately, the Republican Party has hijacked the government by using wedge issues. The party, mostly financed and run by big corporations and insurance companies, has used issues like gay marriage, gun control, and abortion to rally a group of very good and wonderful people to vote republican even though this does not make economic sense for the common man. These big companies spew poisonous gas and chemicals into the air and water. They raise your insurance rates and then fight your claims. They put caps on lawsuits to protects doctors, and gerrymander civil procedure to protect pharmaceutical companies. Half my friends are Republicans, although I am not. These good Americans are my neighbors and my co-workers and my family members. We are, after all, the United States of American. But we shall no longer be victims.

These wedge issues have very little to do with your life. How many gay people do you even know? How many women do you know personally that have had an abortion? (This issue admittedly is quite complex but is still nonetheless used by the Republican party to try and obtain votes). And no one in the Democratic party, since Clinton, has tried to curtail gun ownership, and even then it was for assault type weapons and some forms of ammunition that was particularly deadly. (In fact, since the moratorium on weapons has expired, these particularly deadly weapons are being smuggle into Mexico to fuel the drug war). These issues send the common man down the wrong trail at election time. However, things have changed on the national level. The country has voted for change, and change it shall get. However, the State of Texas is still behind, but there is hope. Before you stubbornly refuse to even consider voting for a Democrat, ask yourself what issues effect you personally, and vote for the man, not the party. I have crossed party lines to vote for good men in the Republican party.

Governor Perry recently stated on National Television that the State of Texas should succeed from the Union. I have never been so embarrassed for my state in my life. This Governor, for political reasons, has refused to accept money from the federal government for unemployment claims (middle class people who can't find work) so that he can cater to the ultra right wing conservatives. It is easy to see who he really works for. These people and this government does nothing for the common man, for the single mom trying to send her kids to college, for the injured worker who can't feed his family, or for the middle class in general. Can't we be a kinder and gentler state? As it is, we are know as the redneck state that kills more people on death row than the rest of the country combined. But, as an experienced criminal attorney, I can tell you that justice is denied in many cases. People that are mentally incompetent are being tried and executed. Judges deny perfectly good motions by defendants who are trying to assert their constitutional rights, knowing that the Republican appellate courts will not overturn them, thereby destroying our civil rights. These vital rights, like the right to remain silent, the right to resist unreasonable searches and seizures, and the right to speedy trial are being denied statewide. I have seen people held in jail against their rights (you have a right to be free on bail until proven guilty) just to satisfy the political agenda of a particular judge wanting to be hard on crime. But what these judges and politicians are doing is destroying our constitutional rights. How is this honorable? How is this Texan? How is this American? This state, although strong and independent, used to be an example for the world of how to work together and take care of one another. We had a proud tradition of independence and strength, and we took care of our own.

Changes are occurring in the State Legislature, with an almost even tie between Republicans and Democrats in the house (I think Republicans lead by one), although the senate is not so close. Demographics show a shifting political map in the big cities, and all along the Rio Grand and the Border counties close to Mexico. There is hope that a government for the people will be revived in the next election cycle, or two election cycles. THE POINT OF THIS COMMENTARY IS TO ENCOURAGE YOU TO VOTE YOUR OWN INTERESTS. Don't be fooled by wedge issues, vote for yourself, for your family, and for your kids. We want to clean up this country, this economy, this environment. Big business has no interest in so doing.
